Applicability
These sales terms apply to all sales of refurbished VanMoof S3 and X3 bikes by MME Dienstverlening (hereinafter: MME) to consumers, regardless of whether the sale is concluded via mmedienstverlening.nl, in person, or via another platform on which MME offers its bikes.
By purchasing a bike from MME you agree to these terms. These terms do not affect your mandatory rights as a consumer.
Our bikes
MME only sells overhauled and signed VanMoof S3 and X3 bikes. VanMoof S3 and X3 models are no longer manufactured new. Every bike we offer is by definition second-hand and refurbished by us for resale. For each bike we state its general condition and mileage.
The purchase agreement
A purchase agreement is concluded the moment MME confirms your order or verbal arrangement in writing via WhatsApp or email. For online sales we confirm every order by email.
Our prices include VAT. MME applies the margin scheme for second-hand goods, so VAT is not stated separately on the invoice.
Payment
Payment is made prior to delivery, via an iDEAL payment request that MME sends after confirming the order. MME does not accept cash and does not offer payment terms.
Only after payment has been received is the bike delivered or made available for pick-up.
Delivery
MME offers three delivery options:
- Pick-up on location
- You collect the bike yourself at TT Vasumweg in Amsterdam, at a pre-arranged time.
- Delivery within the Randstad
- MME delivers free of charge within the Randstad area, at a pre-arranged time.
- Delivery outside the Randstad
- MME delivers throughout the Netherlands via a regular courier. The costs are clearly stated upfront with your order.
The delivery time is in principle within fourteen days of payment received, unless otherwise agreed. MME will inform you in time if this deadline cannot be met.
Transfer of risk
The risk for the bike passes from MME to you the moment the bike is handed over to you, or the moment you or a third party designated by you accepts the bike at the agreed location.
Any transport damage must be reported to MME within twenty-four hours of receipt via info@mmedienstverlening.nl or WhatsApp.
Right of withdrawal
For an online purchase or distance sale you have fourteen days statutory cooling-off period, without having to state a reason. This period starts on the day you or a third party designated by you receives the bike.
Within these fourteen days you may withdraw the purchase by notifying MME via info@mmedienstverlening.nl, via WhatsApp, or by using the model withdrawal form.
During the cooling-off period you may try the bike as you would in a physical shop. If you use the bike more intensively or for longer than is reasonable for this assessment, MME may charge a depreciation against the refund.
Return after withdrawal
On withdrawal, MME picks up the bike via the same courier that delivered it, regardless of where in the Netherlands you live. Pick-up is free. You do not need to arrange anything yourself; MME will contact you after receiving your withdrawal to schedule a pick-up.
You must offer the bike in undamaged condition, in the packaging or in the manner in which you received it, as far as reasonably possible.
MME will refund the full purchase price to you, including any original delivery costs, within fourteen days of receiving the returned bike. Refunds are made via the same payment method you used.
Warranty
The warranty includes repair or replacement of defective parts, or a refund if repair or replacement is not reasonably possible.
Our warranty is separate from and additional to your statutory rights as a consumer. Statutory conformity under Article 7:17 of the Dutch Civil Code remains fully applicable.
What is not covered by the warranty
- Damage caused by falls, accidents, vandalism or theft attempts.
- Damage caused by improper use, incorrect assembly or overloading.
- Cosmetic damage occurring after purchase.
- Damage caused by corrosion, moisture or water ingress.
- Damage caused by deep discharge of the battery (kept above thirty percent during longer storage).
- Damage caused by incorrect charging or using a non-original charger.
- Modifications or repairs by third parties or by yourself after purchase, including speed modifications.
- Normal wear of wear-sensitive parts — chain, brake pads, tyres, cables and lights.
- Broken spokes, which in almost all cases result from accidents or improper use.
- Damage caused by commercial use — food delivery, shared bike rental or professional deployment.
- Damage resulting from the use of a third-party speed-modified bike on public roads.
- Indirect damage, consequential damage and non-material damage.
How to use the warranty
Found a defect within the warranty period on your bike purchased from MME? Contact us as soon as possible via info@mmedienstverlening.nl or WhatsApp +31 6 21302552. Provide your name, the frame number, a short description of the issue, and preferably a photo or video.
MME assesses the claim and informs you within fourteen days about the proposed solution. If repair or replacement is indicated, MME does this free of charge at the workshop or, where practical, at your home within the Randstad. For customers outside the Randstad MME arranges pick-up and return via the regular courier, again at no cost to you.
Ownership verification on sale
MME only sells bikes whose lawful ownership has been established and which are not registered as stolen. With every sale we transfer the bike digitally to you, including the link with the VanMoof account and, if applicable, the Apple Find My status. You receive the matching invoice as proof of lawful purchase.
Liability
MME’s liability on sale is limited to the amount of the purchase price of the bike, except in cases of intent or wilful recklessness on the part of MME.
MME is not liable for damage arising from use of the bike in violation of the Dutch Road Traffic Act, including the use of a speed-modified bike on public roads.
Complaints and disputes
Report complaints via info@mmedienstverlening.nl or WhatsApp. MME responds within fourteen days.
These sales terms and all sales agreements between you and MME are governed exclusively by Dutch law. Disputes that cannot be resolved amicably are submitted to the competent Dutch court.
